{"id":44925,"date":"2016-11-29T09:58:32","date_gmt":"2016-11-29T17:58:32","guid":{"rendered":"http:\/\/www.trektoday.com\/content\/?p=44925"},"modified":"2016-11-29T09:58:32","modified_gmt":"2016-11-29T17:58:32","slug":"axanar-lawyers-its-a-mockumentary","status":"publish","type":"post","link":"https:\/\/trektoday.com\/content\/2016\/11\/axanar-lawyers-its-a-mockumentary\/","title":{"rendered":"Axanar Lawyers: It&#8217;s A Mockumentary"},"content":{"rendered":"<p>According to the lawyers representing <em>Axanar Productions<\/em>, the project was meant as a mockumentary, and did not, therefore, infringe upon <em>Star Trek<\/em> and did not financially harm the studios.<\/p>\n<p>&#8220;<em>Prelude<\/em> (and potentially <em>Axanar<\/em>) uses a unique &#8216;mockumentary&#8217; style previously unused in plaintiffs&#8217; works to tell an original story,&#8221; said <strong>Erin Ranahan<\/strong>, the lawyer representing <em>Axanar Productions<\/em>. &#8220;A &#8216;mockumentary&#8217; has been defined on <em>Wikipedia<\/em> as a &#8216;parody.'&#8221;<\/p>\n<p>Lawyers for <strong>CBS <em>and<\/em> Paramount<\/strong> did not agree with the claim that it was a parody, however. &#8220;The<em> Axanar<\/em> works do not &#8216;transform\u2019 plaintiffs&#8217; intellectual property into any new or different medium,&#8221; they said. &#8220;Defendants intended to, and did, create audio visual <em>Star Trek<\/em> works. Defendants have expanded upon a <em>Star Trek<\/em> story, and they have set that story a few years before the timeline of the original <em>Star Trek<\/em> television series.<\/p>\n<p>&#8220;Defendants have not cited a single case in the history of copyright jurisprudence that finds this kind of activity &#8216;transformative,&#8217; or that would permit what defendants are attempting to do here.&#8221;<\/p>\n<p>As for creating original characters, those characters are based on races created by<em> Star Trek<\/em> and are therefore not original,&#8221; claim the <em>CBS\/Paramount<\/em> lawyers. &#8220;Defendants have not merely taken a smattering of unprotectable elements and combined them,&#8221; they said. &#8220;Instead, defendants have faithfully recreated every possible element of the <em>Star Trek<\/em> universe, down to excruciating details.<\/p>\n<p>&#8220;Further, while defendants assert that they have included additional &#8216;original&#8217; characters in the <em>Axanar<\/em> works, these additional characters are by no means &#8216;original&#8217; \u2013 they are Klingons, Vulcans and Federation officers and are, therefore, not &#8216;original&#8217; to defendants.&#8221;<\/p>\n<p>Both sides of the lawsuit are hoping for summary judgment.
