No Delay For Axanar Case

A request from CBS Corporation/Paramount for more time to respond to a Axanar’s motion for dismissal of the lawsuit was denied by the judge on Friday.

The three week delay had been requested because an attorney was involved in an unrelated trial that would “complicate the timeline in filing the request.”

With the denial, CBS and Paramount had to file a response to Axanar‘s motion by yesterday, and Axanar‘s deadline to rebut it was March 7, with a final hearing on their motion set for March 21st.

A motion for dismissal is something that is standard on the part of a legal team for a defendant. The motive is “to test whether a plaintiff’s suit meets the minimum technical requirements of filing.” Even if a case is dismissed or part of the complaint is struck down, a plaintiff in the case can “correct its lawsuit and refile.”
